1. Agreement to Terms
By accessing or using HireChisholm.com (the “Site”), operated by Chisholm (“we,” “us,” or “our”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you must not access or use the Site or any of our services.
These Terms constitute a legally binding agreement between you and Chisholm governing your use of the Site, booking of services, and any related transactions.
2. Services
HireChisholm.com is a freelance consulting and development booking platform. We offer the following services:
- AI and SaaS application development
- Web design and development
- Video production and editing
- Technology consulting and advisory
The specific scope, deliverables, and timeline for each engagement will be discussed and agreed upon prior to booking. All services are provided on a freelance, independent contractor basis.
3. Booking & Payment
Hourly Rate: All consulting and development services are billed at $100.00 USD per hour.
Deposit: A non-refundable deposit of 50% of the estimated project total is required at the time of booking to secure your engagement. Deposits are processed securely via Stripe.
Remaining Balance: The remaining 50% is due upon project completion or at the end of the agreed-upon engagement period, unless otherwise arranged in writing.
Payment Processing: All payments are processed through Stripe. By making a payment, you also agree to Stripe's Terms of Service. We do not store your payment information on our servers.
Invoicing: Invoices will be provided for all transactions. Additional hours beyond the original estimate will be communicated and approved by you before work begins.
4. Cancellation & Refund Policy
24-Hour Cancellation: You may cancel a scheduled booking at no charge up to 24 hours before the scheduled start time. Cancellations made within this window are eligible for a full refund of the deposit.
Late Cancellations: Cancellations made less than 24 hours before the scheduled start time will forfeit the 50% deposit.
No-Shows: Failure to attend a scheduled session without prior notice will result in forfeiture of the deposit.
Refund Processing: Approved refunds will be processed via Stripe within 5–10 business days to the original payment method.
Project Cancellations: If a project is cancelled mid-engagement, you will be billed for all hours worked to date. Any remaining deposit balance will be applied to hours completed.
5. Intellectual Property
Client Deliverables: Upon full payment, you will own all rights to the final deliverables produced specifically for your project, unless otherwise agreed in writing.
Pre-Existing Materials: We retain all rights to pre-existing tools, libraries, frameworks, templates, and methodologies used in the delivery of services. You are granted a non-exclusive, perpetual license to use such materials as part of your deliverables.
Portfolio Rights: We reserve the right to display completed work in our portfolio and marketing materials unless you request otherwise in writing.
6. Limitation of Liability
To the maximum extent permitted by applicable law, Chisholm shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising out of or related to your use of the Site or services.
Our total liability for any claim arising from or related to these Terms or the services provided shall not exceed the total amount paid by you to Chisholm in the twelve (12) months preceding the claim.
Services are provided “as is” and “as available.” We make no warranties, express or implied, regarding the suitability, reliability, or accuracy of the services for your particular purpose.
7. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved exclusively in the state or federal courts located in Travis County, Texas.

We reserve the right to update or modify these Terms at any time. Changes will be effective immediately upon posting to the Site with an updated “Last updated” date. Your continued use of the Site after any changes constitutes your acceptance of the revised Terms.
